more than two million people are incarcerated in American prisons or jails today.  Approximately one quarter of
the people held in those prisons or jails have been convicted of a drug offense.  Likewise, the United States
incarcerates more people for drug offenses than any other country.

Illinois and Federal Drug Offenses – Penalties

Under Illinois law, most of the offenses with respect to drugs are classified as felonies except possession of
small quantities of marijuana (less than 30 grams) which are designated as misdemeanors. The class of
felony and the penalty imposed depends largely on the weight of the narcotic involved. All felony drug offenses
carry substantial penalties in terms of jail or prison time, fines or assessments, fees, and forfeiture of assets
upon a conviction for the drug offense.  Convictions for felony drug offenses can have collateral consequences
as well in terms of employment, receipt of welfare benefits, access to public housing, and eligibility for student
loans.    

Federal drug offenses have a similar scheme of penalties only the consequences can be far more severe
upon conviction in federal court.
