When someone has died as a result of the actions of another, it is a serious criminal matter and the personal
consequences for the accused can be great. Homicide can occur under various circumstances – and as a result the
charges could range from First Degree Murder to Reckless Homicide.
In Illinois, a person who kills an individual without lawful justification commits First Degree Murder if he intends to kill or
do great bodily harm to that individual or he is committing a forcible felony. If certain aggravating factors are present,
one could be eligible for the death penalty if found guilty of First Degree Murder. Imprisonment for this offense is a
minimum of 20 years to a maximum of life. 720 ILCS 5/9-1 One hundred percent of the sentence will be served.
A Defense to Murder
A possible defense to a First Degree Murder charge is that the actions of the accused constituted Second Degree
Murder. Under Illinois law, Second Degree Murder occurs when a person acts under a sudden and intense passion
resulting from serious provocation by the individual killed or at the time of the killing, he acted under the unreasonable
belief that his actions were justified by self-defense or defense of another. 720 ILCS 5/9-2. Second Degree Murder is a
Class 1 felony. Imprisonment for this offense is not less than 4 yrs and not more than 15 yrs. Probation for up to 4 yrs
is an option.

Other Violent Crimes in Illinois and Penalties
The offense of Battery occurs when a person intentionally or knowingly without legal justification and by any means
causes bodily harm to an individual or makes physical contact of an insulting or provoking nature with an individual.
Battery is a Class A misdemeanor. Possible jail time is up to 365 days with the possibility of probation or supervision.
720 ILCS 5/12-3.
A person, who in committing battery, intentionally or knowingly causes great bodily harm, or permanent disability or
disfigurement commits the offense of Aggravated Battery. This offense is a Class 3 felony but it can be a Class 1
felony or a Class 2 felony under certain circumstances and with certain individuals. 720 ILCS 5/12-4. Imprisonment for
a Class 1 felony ranges from 4 to 15 yrs. Aggravated Battery with a Firearm is a Class X felony which carries a prison
term of 6 to 30 yrs. 720 ILCS 5/12-4.2 (a)(1).

A person commits the offense of Robbery when he takes property from the person or presence of another by the use of
force or by threatening the imminent use of force. Robbery is a Class 2 felony. Under some circumstances, Robbery
can be a Class 1 or Class 2 felony. 720 ILCS 5/18-1. Armed Robbery is Class X felony which carries a sentence of 6
to 30 yrs. If a firearm was used and great bodily harm occurred, the sentence can be substantially longer. 720 ILCS
5/18-2.
