Marilyn A. Miller is a seasoned criminal defense lawyer with over 30 years of experience defending serious
felonies and misdemeanors in both state and federal court.  She obtained a Juris Doctor degree from a top
law school, Chicago-Kent College of Law, and was admitted to the Illinois Bar in 1979.  As a dedicated
criminal trial lawyer, Ms. Miller has tried over forty jury trials and hundreds of bench trials, defended capital
cases and negotiated reduced penalties for serious offenses.  She is respected and very well regarded not
only by the Illinois and federal judges before whom she has appeared, but has the well-earned respect from
the prosecutors who have been her opponents in the courtroom.

Our Defense Strategy

We begin our legal work on a case by conducting an in-depth interview with the client to determine the facts,
circumstances, and identity of witnesses in the case.  Next, we obtain the police reports, laboratory reports,
transcripts, and other documentary evidence relevant to the case.  Upon review of these materials, a thorough
investigation of the case is done including a visit to the scene and interviews of witnesses.  Simultaneously,
the case is being analyzed with a view toward potential defenses to be raised as well as mitigating evidence
to be used in the case.  Extensive legal research is also conducted as part of the development of the               
defense.  The services of an investigator may also be utilized to assist in the investigation of the case.  
Finally, a credible theory of defense is developed as part of the strategy for trial.    

As part of the defense of the case, there may also be various pre-trial motions to be presented to the court to
challenge the probable cause to arrest and/or to search, the voluntariness of a confession or statement,  the
suggestibility of an identification, and so forth.  A hearing on these motions will be conducted and the court
will make its ruling.

Finally, a decision must be made by the client, with the advise of counsel, as to whether to proceed to trial as
well as which type of trial, bench or jury, is in the best interest of the client.  It is our preference to proceed to
trial if the facts of the case warrant it and the client desires it.  On the other hand, the client may want to              
negotiate with the prosecutor for a reduced penalty in return for a plea of guilty to the charge or a reduced
charge.  A client now in a better position to negotiate a more reasonable resolution of the case because the
case is ready for trial with a winning strategy in place.
